These Terms & Conditions ("Terms") govern your access to and use of Shikhar Education’s website, mobile applications, physical centers, and related services. By accessing our services, you agree to be bound by these Terms.

PART A: TERMS FOR STUDENTS AND PARENTS/GUARDIANS

Common Flaw Addressed: Standard educational T&Cs often imply academic guarantees, leading to severe liability if a student fails. The clauses below strip away implied warranties.

1. Academic Disclaimer and Limitation of Liability

1. No Guarantee of Results: Shikhar Education provides educational resources, tutoring, and assessment tools. We explicitly disavow any guarantee, warranty, or representation regarding academic outcomes, board examination results, or admission to higher education institutions.
2. Student Responsibility: Educational success depends entirely on the individual student's effort, attendance, and adherence to the curriculum. Shikhar Education is not liable for academic underperformance.

2. Enrollment, Fees, and Strict Refund Policy

Common Flaw Addressed: Ambiguous refund windows invite endless disputes and chargebacks. This requires an absolute cutoff.

1. Payment Obligations: All tuition and administrative fees must be paid strictly according to the schedule provided at the time of enrollment. Failure to pay will result in the immediate suspension of access to physical classes and digital Learning Management Systems.
2. No-Refund Policy: Except as mandated by local statutory law, all fees paid to Shikhar Education are strictly non-refundable after a [Insert Number, e.g., 7-day] cooling-off period from the date of enrollment. PART B: TERMS FOR FRANCHISEES AND PARTNERS

Common Flaw Addressed: Franchisors often lose control over brand messaging and intellectual property (IP) because their T&Cs are too passive. These clauses assert absolute dominance over the brand asset.

4. Intellectual Property and Brand Integrity

1. Absolute Ownership: Shikhar Education retains exclusive, indisputable ownership of all trademarks, service marks, logos, curriculum designs, teaching methodologies, study materials, and proprietary software.
2. Prohibition on Unauthorized Modification: Franchisees are granted a revocable, non-exclusive license to use these materials solely for operating the specific authorized center. Franchisees shall not alter, reproduce, distribute, or sub-license any Shikhar Education intellectual property without express, written corporate approval.
3. Breach Consequence: Any unauthorized distribution or adaptation of our IP constitutes material breach, resulting in immediate termination of the franchise agreement and triggering liquidated damages.

5. Independent Contractor Status

Common Flaw Addressed: Vicarious liability. If a franchisee makes a mistake, the parent company gets sued. This clause forces the franchisee to bear their own legal burdens.

1. Franchisees operate as independent business entities. These Terms do not create a partnership, joint venture, agency, or employer-employee relationship between Shikhar Education and the Franchisee.
2. The Franchisee is solely responsible for its own taxation, employee payroll, local regulatory compliance, and operational liabilities. Shikhar Education explicitly disclaims liability for any debts, torts, or contractual obligations incurred by the Franchisee.

6. Marketing and Communications Strictures

1. Franchisees may not run independent digital, print, or social media advertising campaigns using the Shikhar Education brand name without prior clearance from the central marketing division. Rogue marketing campaigns that dilute the brand identity will result in financial penalties.

7. Audit Rights and Quality Control

1. To ensure uniform academic and operational standards, Shikhar Education reserves the right to conduct unannounced physical and digital audits of any franchise center. Refusal to comply with an audit, or failure to rectify identified deficiencies within [Insert Number] days, constitutes grounds for immediate termination.

PART C: GENERAL PROVISIONS (APPLICABLE TO ALL USERS)

8. Dispute Resolution and Governing Law
